Terms of Use

These Terms of Use (“Terms”) govern your access to and use of https://myashhealth.com, related webpages, portals, features, communications, and services made available by AshHEALTH, LLC d/b/a MyAshHealth (“MyAshHealth,” “we,” “us,” or “our”). By accessing or using the Site or Services, you agree to these Terms. If you do not agree, do not use the Site or Services.
1. About MyAshHealth
MyAshHealth is a digital-health marketplace and administrative platform operated by AshHEALTH, LLC d/b/a MyAshHealth. MyAshHealth facilitates access to independently licensed healthcare professionals, licensed pharmacies, independent third-party laboratories, and other service providers. MyAshHealth does not control the independent clinical judgment of participating healthcare professionals and does not itself prescribe or dispense prescription medications.
AshHEALTH, LLC d/b/a MyAshHealth is a HIPAA covered entity with respect to protected health information maintained by it in its covered-entity capacity. Our privacy practices are described in our Privacy Policy and HIPAA Notice of Privacy Practices.
2. Eligibility and Age Requirement
The Site and Services are intended only for adults who are at least 18 years old. MyAshHealth does not provide services to minors through the Site. By using the Site or Services, you represent that you are at least 18 years of age and legally capable of entering into these Terms.
3. Not Emergency Care
MyAshHealth does not provide emergency medical services. If you are experiencing a medical emergency, call 911 or seek immediate emergency medical assistance. Do not use the Site, messaging features, or customer support for an emergency.
4. Clinical Services and Independent Medical Judgment
Educational content on the Site is provided for general informational purposes and is not a substitute for medical advice, diagnosis, or treatment from a qualified healthcare professional. Clinical services made accessible through MyAshHealth are provided by independently licensed healthcare professionals who are responsible for evaluating whether treatment is clinically appropriate.
No medication, prescription, laboratory test, treatment, result, or clinical outcome is guaranteed. A prescriber may approve a requested treatment, recommend an alternative, require laboratory testing or additional information, or decline to prescribe based on professional judgment and applicable law.
5. Prescription Medications and Pharmacies
Prescription medications require a valid prescription from a licensed prescriber. Prescriptions are dispensed by licensed pharmacies. MyAshHealth does not dispense medications and does not control a pharmacy’s professional, fulfillment, shipping, inventory, or dispensing decisions. Certain medications offered through programs may be compounded. Compounded medications are not FDA-approved and are not reviewed by the FDA for safety, effectiveness, or quality in the same manner as FDA-approved drugs.
Where permitted by the applicable program, law, and pharmacy workflow, a patient may request that a prescription be directed to a pharmacy of the patient’s choosing. Availability, pricing, and fulfillment may differ when a patient selects a pharmacy outside a program’s participating pharmacy network.
6. Laboratory Services
MyAshHealth may provide access to laboratory testing performed by independent third-party laboratories. MyAshHealth does not perform the laboratory testing. Scheduling, specimen collection, insurance or cash billing, test availability, laboratory processing, cancellation rules, and other laboratory-specific requirements may be governed by the third-party laboratory’s terms and policies. A healthcare professional may require laboratory testing before or during treatment.
7. Orders, Charges, Prescribing Decisions, and Refunds
Depending on the program and workflow, you may be charged before or after a prescriber makes a prescribing decision. Payment does not guarantee that a prescription will be issued. If a prescriber does not prescribe for a specific order and MyAshHealth collected payment for that order, all monies collected by MyAshHealth for that specific unprescribed order will be refunded in accordance with the Returns & Refund Policy. Other completed, prescribed, dispensed, laboratory, or unrelated orders are not automatically affected by that refund.
Once a prescription medication has been dispensed, it generally cannot be returned or resold. Additional cancellation, shipping, damaged-package, subscription, and laboratory rules are stated in the Returns & Refund Policy.
8. Payment and Insurance
Unless expressly stated otherwise for a particular service, MyAshHealth programs are not health insurance and are not a substitute for health insurance. Prices may include technology, administrative, support, professional, laboratory, pharmacy, or other program components depending on the offering. Your eligibility to use HSA/FSA funds or seek reimbursement is determined by applicable plan rules and law. You are responsible for determining whether a charge is reimbursable by any insurer or benefit plan.
9. Account Responsibilities
You agree to provide accurate, current, and complete information and to keep your account credentials confidential. You are responsible for activity conducted through your account. You may not impersonate another person, provide false medical or identity information, attempt unauthorized access, interfere with Site security, introduce malicious code, scrape or misuse Site content, or use the Site for unlawful purposes.
10. Electronic Communications
You agree that MyAshHealth may provide transactional and service-related communications electronically, including by email, portal message, telephone, or text message where permitted. Marketing text messages will be sent only as permitted by applicable law and the choices you make. SMS participation is governed by the separate SMS Terms and Conditions. Consent to receive marketing text messages is not a condition of purchase.
11. Privacy
Our collection, use, disclosure, and protection of information are described in our Privacy Policy and, for protected health information subject to HIPAA, our HIPAA Notice of Privacy Practices. If there is a conflict concerning PHI, the HIPAA Notice of Privacy Practices controls to the extent required by law.
12. Intellectual Property
The Site and its content, including text, graphics, logos, icons, images, software, design elements, and compilations, are owned by or licensed to AshHEALTH, LLC and are protected by applicable intellectual-property laws. You receive a limited, revocable, nonexclusive right to use the Site for your personal, lawful use. You may not copy, modify, reproduce, distribute, sell, license, create derivative works from, or commercially exploit Site content except as permitted by law or with our written authorization.
13. Third-Party Services and Links
The Site may connect you with or link to independent healthcare professionals, pharmacies, laboratories, payment processors, technology vendors, or other third parties. Those third parties may have separate terms, privacy notices, clinical responsibilities, or policies. MyAshHealth is not responsible for a third party’s independent acts or omissions except to the extent required by applicable law.
14. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND NON-CLINICAL PLATFORM SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” MYASHHEALTH DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. NOTHING IN THESE TERMS DISCLAIMS RESPONSIBILITIES THAT CANNOT LAWFULLY BE DISCLAIMED.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ASHHEALTH, LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR NON-CLINICAL PLATFORM SERVICES. THIS LIMITATION DOES NOT APPLY WHERE PROHIBITED BY LAW AND DOES NOT ALTER THE INDEPENDENT PROFESSIONAL RESPONSIBILITIES OF A LICENSED HEALTHCARE PROFESSIONAL, PHARMACY, OR LABORATORY.
16. Suspension or Termination
We may suspend or terminate access to the Site for security, fraud prevention, unlawful conduct, material violation of these Terms, or other legitimate operational reasons. Provisions that by their nature should survive termination will remain in effect.
17. Governing Law and Consumer Disputes
These Terms and disputes between you and AshHEALTH, LLC arising from the Site or non-clinical MyAshHealth services are governed by the laws of the State of New York, without regard to conflict-of-laws principles, except where federal law or another jurisdiction’s non-waivable consumer-protection law applies. Unless applicable law requires otherwise, any legal action against AshHEALTH, LLC must be brought in a state or federal court with jurisdiction in Monroe County, New York, and you consent to that venue and jurisdiction.
Nothing in this section restricts any right you may have to submit a complaint to a licensing board, governmental agency, regulator, health plan, or other authority.
18. Changes to These Terms
We may update these Terms from time to time. The revised Terms will be posted on the Site with a new effective date. Material changes will be communicated as required by law. Your continued use after an update becomes effective constitutes acceptance to the extent permitted by law.
